This bug can be easily reproduced: create a plane and asign a matte/shadow/reflection material to it, create a light and select "mental ray shadow map" and activate "transparent shadows". After this try to render the scene with Final Gather ON and you'll experience a crash. This happens in 3dsmax 2009 and 3dsmax 2010, dunno in earlier versions.
